Did Kate Middleton and Prince William Sign a Prenup?

Before tying the knot, some engaged duos choose to sign a prenuptial agreement, otherwise known as a prenup, to protect their wealth and assets—and avoid long, tiresome court proceedings—if their relationship ends in divorce. While arranging this legally binding contract gives some couples a sense of security, others see its presence as a sign of distrust in the partnership and doubts about its longevity. Ahead of Kate Middleton and Prince William’s wedding in 2011, there were reports that some people in their inner circle advised them to sign a prenup—but they refused. However, senior royal sources shut down these claims, noting that a prenup was never suggested in the first place.

The Mirror recently reported that shortly after William popped the question in November 2010, Princess Diana’s former private secretary, Patrick Jephson, allegedly voiced that Kate should sign a prenup before marrying into the royal family. “If she was my sister, I’d tell her to get a good prenup,” he reportedly warned, per the outlet. “Kate’s not just going into a marriage; she’s going into a business.” A prenup would guarantee that Kate would continue to live a certain lifestyle if she and William split.

Despite supposed pressure from outside sources, Kate and William never signed a legally binding document that would safeguard their possessions and lifestyle—and they never had one drawn up in the first place, according to senior royal sources. “For him to refuse, it would have had to have been suggested to him by someone and it was not,” an insider told The Daily Mail. “There is no prenuptial agreement in place for this wedding.”

It sounds like this is royal precedent: Prior to the Prince and Princess of Wales’ 2011 nuptials, neither the late Princess Diana and King Charles III nor Sarah Ferguson and Prince Andrew signed a prenup. Since both pairs didn’t have this premarital document set in place, each couple had different financial proceedings after finalizing their divorces, which lawyers were left to battle out. According to The Mirror, the Duchess of York received nearly $20,000 a year from Prince Andrew when their marriage ended in 1996 (a decade after they wed). Diana, on the other hand, received a $22 million payoff, thanks to her lawyers, per the publication.

When Kate’s sister-in-law, Meghan Markle, married Prince Harry, they also didn’t sign a prenuptial agreement. According to Katie Nicholl, author of Harry: Life, Loss, and Love, it isn’t common for members of the royal family to have a prenup since much of the royal’s wealth belongs to the monarch, Town & Country reported. Nicholl explains that since most of Harry’s finances belonged to the late Queen Elizabeth II (with the exception of his inheritance from his mother, the late Princess Diana, after her death in 1997), he wouldn’t split that sum with Meghan if they did end up getting a divorce.
